Core Responsibilities

Primary Functions

  • Manage a full civil litigation caseload from initial intake through resolution, including evaluation of claims, development of litigation strategy, and execution of discovery, pleadings, motions, and trial preparation for state and/or federal court matters.
  • Draft, review, and file substantive pleadings and motions—such as complaints, answers, third-party complaints, dispositive motions (motions for summary judgment), and motions in limine—ensuring accuracy, persuasive legal analysis, and compliance with local and federal rules.
  • Lead discovery efforts: prepare and respond to written discovery (interrogatories, requests for production, requests for admission), coordinate collection and production of documents, manage privilege logs, and supervise e-discovery workflows with vendor partners.
  • Plan, take, and defend depositions of fact witnesses, experts, parties, and corporate designees; prepare thorough deposition outlines and impeachment exhibits; coordinate witness preparation and scheduling.
  • Conduct in-depth legal research and analysis on novel and complex issues, synthesize legal authority and factual patterns, and prepare research memoranda and legal opinions to support litigation strategy and client counseling.
  • Prepare clients, witnesses, and experts for hearings and trials; develop theme and theory for trial presentation, organize trial exhibits and demonstratives, and coordinate logistics with court personnel and vendors.
  • Develop and implement case budgets, monitor litigation expenses, and provide periodic budget-to-actual reporting to clients or internal finance teams to ensure cost-effective representation.
  • Negotiate settlements, mediations, and other ADR processes on behalf of clients; prepare mediation briefs and settlement authority memoranda and execute negotiated settlement agreements and releases.
  • Supervise and mentor junior associates, paralegals, and legal assistants; delegate tasks, review work product, provide constructive feedback, and foster professional development in litigation practice.
  • Serve as primary point of contact for clients and internal stakeholders; provide timely, strategic updates, manage client expectations, and advise on litigation risk, potential outcomes, and resolution options.
  • Manage complex multi-party litigation and coordinate cross-jurisdictional matters, ensuring compliance with jurisdictional rules, venue considerations, and simultaneous filings in multiple forums when necessary.
  • Prepare and argue motions at pre-trial and trial-level hearings, including evidentiary motions, discovery motions, and emergency relief applications; present oral argument that persuasively advocates for client positions.
  • Retain, manage, and evaluate expert witnesses; coordinate expert disclosures, support expert reports and depositions, and implement strategies to bolster or challenge expert testimony.
  • Oversee post-trial matters including judgment enforcement, post-trial motions (e.g., motions for new trial, motions to alter or amend judgment), and appellate record preparation when an appeal is warranted.
  • Implement and maintain litigation holds, ensure preservation of electronically stored information (ESI), and coordinate with IT and vendors to meet e-discovery preservation and collection obligations.
  • Draft and review settlement agreements, releases, confidentiality agreements, and related transactional documents to ensure enforceability and protect client interests.
  • Conduct internal investigations and pre-litigation counseling, perform risk assessments, and provide recommendations to avoid litigation or minimize exposure based on legal and factual analysis.
  • Ensure strict compliance with court rules, ethical obligations, filing deadlines, and jurisdiction-specific procedural requirements; proactively manage docket and calendar to avoid default or procedural missteps.
  • Utilize litigation technology and case management tools (e.g., Relativity, Concordance, LexisNexis, Westlaw, iManage, Clio) to streamline document review, manage matter files, and optimize discovery workflows.
  • Prepare persuasive, client-facing status reports, litigation updates, and board-level summaries that translate complex legal issues into actionable business recommendations.
  • Collaborate with insurance carriers, claims handlers, and external counsel on coverage issues, reservations of rights, and coordinated defense strategies.
  • Develop and maintain relationships with local counsel, co-counsel, and outside vendors to build litigation coalitions and effectively staff matters requiring specialized expertise.
  • Monitor and apply developments in case law and statutory changes that affect ongoing litigation strategy and proactively update internal stakeholders on material changes.
  • Lead settlement strategy sessions with clients and cross-functional teams, evaluate economic and reputational considerations, and prepare settlement authority matrices and negotiation parameters.
  • Conduct cost-benefit analyses of litigation pathways (litigate, mediate, settle, arbitrate) and present clear recommendations that balance legal risk with commercial objectives.
  • Coordinate and supervise forensic data collection and analysis in complex matters involving large data sets, cybersecurity issues, or specialized technical evidence.

  • Support business development initiatives by drafting bios, contributing to pitch materials, participating in client meetings, and generating thought leadership (articles, presentations) on civil litigation topics.
  • Maintain and update matter templates, checklists, and precedent libraries to improve consistency and efficiency across the litigation team.

Education & Experience

Educational Background

Minimum Education:

  • Juris Doctor (JD) or equivalent from an accredited law school.
  • Admission to the state bar where litigation will be practiced; active standing required.

Preferred Education:

  • Advanced legal degrees (LLM in Litigation, Trial Advocacy, or related field) or certificate in e-discovery/trial advocacy.
  • Judicial clerkship experience or specialized training (trial advocacy programs, mediation training).

Relevant Fields of Study:
