Core Responsibilities

Primary Functions

  • Draft, review, and execute sophisticated estate planning documents, including wills, revocable and irrevocable trusts (such as ILITs, GRATs, QPRTs, and dynasty trusts), durable powers of attorney, and advance health care directives.
  • Advise high-net-worth and ultra-high-net-worth individuals and families on complex, multi-generational wealth transfer, tax minimization, and asset protection strategies.
  • Analyze client financial situations, including complex asset portfolios, liabilities, and existing estate plans, to identify strategic planning opportunities and risks.
  • Counsel fiduciaries, such as executors and trustees, on their legal duties and responsibilities throughout the complex administration of estates and trusts.

  • Manage all phases of trust and estate administration, including probate court proceedings, the marshalling of assets, preparation of federal and state estate tax returns (Forms 706 and 709), and fiduciary accountings.
  • Develop and present customized estate plan recommendations, summaries, and illustrative flowcharts to clients in a clear, compelling, and understandable manner.
  • Conduct in-depth research and maintain expert-level knowledge of federal, state, and international estate, gift, and generation-skipping transfer (GST) tax laws.
  • Structure and implement comprehensive business succession plans for owners of closely-held businesses, utilizing tools like buy-sell agreements and strategic ownership transfers.
  • Provide expert guidance on sophisticated philanthropic and charitable giving strategies, including the formation and administration of private foundations, charitable remainder trusts (CRTs), and donor-advised funds.
  • Handle the critical process of asset retitling and beneficiary designations to ensure that trusts and other planning vehicles are properly funded.
  • Manage client relationships proactively, ensuring regular communication and periodic reviews of their estate plans to adapt to significant life changes and evolving legal landscapes.
  • Review and interpret complex, and often-dated, trust and will documents to advise beneficiaries and fiduciaries on their specific rights and obligations.
  • Advise clients on special needs planning, including the establishment and administration of Special Needs Trusts (SNTs) to preserve eligibility for essential public benefits.
  • Develop creative strategies for managing, valuing, and transferring unique and illiquid assets, such as art collections, extensive real estate portfolios, and digital assets.
  • Assist clients with the integration of marital planning, including the negotiation and drafting of prenuptial and postnuptial agreements, into their overall estate plan.

Secondary Functions

  • Collaborate seamlessly with clients' other professional advisors, including financial planners, accountants, insurance agents, and investment managers, to create a cohesive and integrated wealth plan.
  • Actively participate in business development and marketing efforts for the firm, including writing thought leadership articles, speaking at seminars, and networking to cultivate new client relationships.
  • Mentor, train, and supervise junior attorneys, paralegals, and support staff within the trusts and estates practice group, fostering their professional growth.
  • Stay at the forefront of the industry by continuously monitoring and analyzing changes in relevant legislation and case law to ensure ongoing compliance and to proactively advise clients.
  • Represent clients in negotiations with the IRS or state taxing authorities regarding gift and estate tax audits and other related controversies.
  • Prepare and file petitions, motions, and other necessary legal documents with the appropriate surrogate's or probate court to advance administration matters.

Required Skills & Competencies

Hard Skills (Technical)

  • Deep, comprehensive understanding of federal and state estate, gift, generation-skipping transfer (GST), and fiduciary income tax laws.
  • Expertise in drafting complex, nuanced, and highly customized legal documents with exceptional precision and attention to detail.
  • Proficiency in the entire trust and estate administration process, from initial probate filing to final distribution and the closing of the estate.
  • Strong technical proficiency with legal research platforms (e.g., Westlaw, LexisNexis) and estate planning/diagramming software (e.g., WealthDocx, Lackner, ForeTrust).
  • Experience preparing and/or reviewing federal gift tax returns (Form 709) and federal estate tax returns (Form 706).
  • Knowledge of corporate and partnership law as it relates to business succession planning for closely-held business owners.

Education & Experience

Educational Background

Minimum Education:

  • Juris Doctor (J.D.) degree from an ABA-accredited law school.
  • Admission to the state bar in the location of practice.

Preferred Education:

  • Master of Laws (LL.M.) in Taxation or Estate Planning.
  • Professional designations such as Certified Financial Planner (CFP®) or Certified Trust and Financial Advisor (CTFA).

Experience Requirements

Typical Experience Range: 5-15+ years of direct experience in a dedicated trusts and estates role.
