Core Responsibilities
Primary Functions
- Manage the complete, end-to-end lifecycle of U.S. non-immigrant (H-1B, L-1, TN, O-1) and immigrant (PERM, I-140, I-485) visa petitions for employees, from initiation to final adjudication.
- Serve as the primary and most trusted point of contact for foreign national employees, their managers, and HR business partners, addressing all inquiries with clarity, empathy, and a high level of service.
- Meticulously prepare and thoroughly review complex visa petitions, applications, and extensive supporting documentation to guarantee absolute accuracy and completeness prior to submission.
- Act as the central coordinator between the company and external immigration counsel, ensuring strategic alignment on case strategy, timely filing, and effective communication flow.
- Proactively track and monitor critical deadlines, visa expiration dates, and case milestones using dedicated case management software (like LawLogix, Tracker, or INSZoom) to prevent any lapses in work authorization.
- Advise recruiting teams and hiring managers on the intricacies of immigration sponsorship, including feasibility, timelines, and potential challenges for prospective candidates.
- Manage the entire PERM labor certification process, including overseeing the mandatory recruitment steps, compiling documentation, and ensuring all Department of Labor (DOL) requirements are met.
- Conduct comprehensive internal audits of I-9 employment eligibility verification forms and E-Verify records to maintain impeccable compliance and readiness for any government inspections.
- Partner with legal counsel to formulate and draft detailed, persuasive responses to government-issued Requests for Evidence (RFEs), gathering necessary information from employees and the business.
- Maintain pristine, confidential, and well-organized employee immigration records and data within both the Human Resources Information System (HRIS) and the immigration case management system.
- Provide clear, compassionate guidance and support to employees and their families as they navigate the often stressful and confusing U.S. immigration system.
- Initiate and oversee the processing of visa applications at U.S. consulates and embassies worldwide, providing employees with guidance on interview preparation and document collection.
- Diligently maintain and audit Public Access Files (PAFs) for H-1B employees, ensuring full compliance with DOL regulations at all times.
- Develop and update internal resource materials, process flowcharts, and frequently asked questions (FAQs) to empower employees and stakeholders with self-service immigration information.
- Generate and present regular reports to leadership on immigration program metrics, including case statuses, cycle times, costs, and overall program health.
- Evaluate current immigration policies and procedures, proactively identifying and recommending process improvements to enhance efficiency, compliance, and the overall employee experience.
- Coordinate the onboarding process for new foreign national hires, ensuring work authorization is secured and documented before their start date.
- Stay abreast of the constantly evolving U.S. immigration laws, regulations, and policy shifts, and effectively communicate the potential impact on the company and its employees.
