Core Responsibilities

Primary Functions

  • Conduct comprehensive prior art searches across global patent databases (e.g., USPTO, EPO, WIPO, Derwent, PatBase) and non-patent literature to evaluate the patentability of new inventions.
  • Perform Freedom-to-Operate (FTO) and clearance searches to identify potential infringement risks associated with new product launches, features, or processes.
  • Analyze search results with a high degree of technical and legal acumen to assess novelty, non-obviousness, and inventive step, providing detailed written opinions to inventors and patent attorneys.
  • Prepare detailed patent landscape analyses to identify technology trends, key players, R&D direction, and white-space opportunities within specific technical domains.
  • Support patent litigation efforts by conducting invalidity/validity searches to challenge or defend the enforceability of asserted patents.
  • Draft clear and concise search reports, summarizing complex technical and legal information for various stakeholders, including R&D teams, legal counsel, and business leaders.
  • Monitor and analyze competitor patenting activities to provide strategic insights and early warnings on emerging threats and opportunities.
  • Assist in the preparation and prosecution of patent applications by providing critical prior art and technical analysis to patent attorneys and agents.
  • Categorize and classify patents and technical documents according to internal taxonomies to build and maintain a searchable IP knowledge base.
  • Collaborate closely with inventors and R&D teams to gain a deep understanding of new technologies and assist in drafting high-quality invention disclosure forms.
  • Utilize advanced search methodologies, including keyword, classification (CPC/IPC), semantic, and citation-based searching, to ensure comprehensive search coverage.
  • Evaluate third-party patent portfolios for potential acquisition, licensing-in, or strategic partnership opportunities.
  • Develop and refine patent search strategies and best practices to improve the efficiency and quality of the IP analysis process.
  • Create and maintain patent watch lists and alerts to stay current on new filings and publications in key technology areas and by key competitors.
  • Support corporate due diligence activities for mergers and acquisitions by assessing the strength, scope, and potential risks of a target company's IP portfolio.
  • Provide training and guidance to engineering and research staff on intellectual property fundamentals and the importance of the invention disclosure process.
  • Analyze patent file histories and prosecution proceedings to understand the scope of patent claims and arguments made to patent offices.
  • Use data visualization tools to present complex patent landscape data in an easily digestible format for executive-level review and strategic planning.
  • Review and interpret patent claims to determine the scope of protection and potential overlap with company products or technology.
  • Maintain proficiency in a variety of professional patent search platforms and analytics tools, staying updated on new features and capabilities.
  • Perform state-of-the-art searches to inform the early stages of research projects, prevent duplication of effort, and guide innovation strategy.
  • Assist in managing the company's patent portfolio by providing data and analysis for maintenance/annuity fee decisions.

Required Skills & Competencies

Hard Skills (Technical)

  • Patent Search Expertise: High-level proficiency with professional patent search databases such as Derwent Innovation, PatBase, Questel Orbit, or AcclaimIP.
  • Search Methodologies: Expertise in conducting patentability, freedom-to-operate (FTO), invalidity, and landscape searches using advanced search techniques.
  • Legal Acumen: Strong understanding of patent law principles, including patentability requirements (e.g., 35 U.S.C. 101, 102, 103) and patent claim interpretation.
  • Technical Domain Knowledge: In-depth technical knowledge in a specific scientific or engineering discipline (e.g., Electrical Engineering, Computer Science, Chemistry, Biotechnology).
  • Database Familiarity: Familiarity with global patent office databases (USPTO, EPO, WIPO) and patent classification systems (CPC, IPC).
  • Patent Analytics: Experience with patent analytics and visualization software (e.g., PatSnap, Cipher) to derive strategic insights from large datasets.

Education & Experience

Educational Background

Minimum Education:

  • Bachelor of Science (B.S.) degree in a technical or scientific field.

  • Registration as a Patent Agent with the USPTO is a significant plus.

Experience Requirements

Typical Experience Range:

  • 2-7 years of direct experience in patent searching and analysis.
