Core Responsibilities
Primary Functions
- Conduct comprehensive examinations of title evidence from public and private records, including deeds, mortgages, easements, and liens, to accurately determine the status of title and property ownership.
- Analyze chains of title and abstract legal documents, identifying potential defects, encumbrances, or unmarketable conditions that could impact the transaction.
- Prepare and issue accurate and timely title commitments and preliminary reports, clearly outlining all requirements, exceptions, and conditions necessary to insure the title.
- Scrutinize complex legal descriptions, plats of survey, and maps to verify property boundaries and identify any discrepancies or encroachments.
- Proactively communicate with clients, including real estate agents, lenders, and attorneys, to explain title findings, requirements, and the process for clearing title issues.
- Collaborate with the escrow and closing teams to resolve title defects, such as obtaining lien releases, subordination agreements, or necessary court orders.
- Determine the insurability of a title based on a thorough risk assessment and in accordance with company underwriting guidelines and state regulations.
- Prepare and issue final lender's and owner's title insurance policies upon successful closing and recording of all required documents.
- Review closing documents, including deeds, mortgages, and settlement statements, for accuracy and compliance prior to disbursement and recording.
- Manage a high-volume pipeline of residential and commercial title orders, prioritizing tasks effectively to meet strict closing deadlines.
- Respond to complex inquiries from all parties involved in the transaction, providing expert guidance on title-related matters with a high level of customer service.
- Maintain an in-depth and current knowledge of real estate law, title insurance regulations, and local recording practices.
- Utilize specialized title production software (e.g., RamQuest, SoftPro, ResWare) to manage files, search records, and generate documents efficiently.
- Coordinate the recording of legal documents with county clerk and recorder offices, ensuring all instruments are filed correctly and in a timely manner.
- Review and approve pro-forma policies and endorsements requested by lenders and other parties, ensuring they meet underwriting standards.
